1.- Identification of the owner and general information

PENTALIUM is the trade name of the company H4.EVOLUTION, S.L. The present Terms and Conditions regulate the access and use of the website. www.pentalium.com (hereinafter, the Website) owned by H4.EVOLUTION, S.L. (from now on, Pentalium), with C.I.F. B-01654219 and social address in Avenida Virgen de Luján 39B, 1b, CP 41011 (Sevilla), as well as the services and products offered by Pentalium in its Web site.

PENTALIUM offers this website subject to these Terms and Conditions. By visiting the Website or using the Website’s services or applications, you agree to these Terms and Conditions.

Users are not required to register to access the website. However, in order to contract any of the services offered by PENTALIUM, the registration of the User and the acceptance of these conditions will be required before formalizing the payment.

Through the Website, PENTALIUM offers Users health, cosmetic and nutraceutical products of the PENTALIUMbrand.

These Terms and Conditions of PENTALIUM described below define the rights and obligations of PENTALIUM and the Users within the framework of the website. These are the only Terms and Conditions applicable to the use of the website (notwithstanding that for certain services there may be specific conditions) and to the contracting of orders through the website and replace any other conditions, unless previously agreed in writing between the following parties PENTALIUM and the User.

2.- User Data

In order to purchase the products offered through the Website it will be necessary for the User to register through the registration form available on the Website.

The User will be responsible for maintaining the confidentiality of the data and information provided and for restricting access to his or her computer and passwords to avoid possible unauthorised use.

In the event that the User has reason to believe that his/her data have been disclosed to a third party, or if they have been used in an unauthorized manner, or are likely to be used in an unauthorized manner, he/she must immediately notify PENTALIUM of this situation.

The User must check that his/her data is correct and complete and inform PENTALIUM when there is any variation and/or modification in the information provided in the purchase process.

3.- Orders and conditions of sale

The services and products offered through the PENTALIUM Website are intended for the purchase by Users of health, cosmetic and nutraceutical products of the PENTALIUMbrand.

In order to place an order with PENTALIUM, the User must be over 18 years of age.

To place orders through the Website, the User must provide a series of data prior to the contracting, through the purchase form, and that will be necessary to manage your purchase order.

4.- Price, payment and discount codes

Once the form data has been completed, the User must proceed to the payment of the order through the means of payment specified on the Website.

After the payment has been made, the User will receive an e-mail confirming the order, which will include a summary of the items purchased, the shipping method requested and the destination address.

If at the time of payment there is an incident that prevents payment, the user will receive an automatic payment error message and your order will not be processed until the payment process is completed successfully.

The prices of the services are expressed in Euros (€), including taxes and management and shipping costs, the amount of which will be indicated at the time of final confirmation of each order.

All prices shown are final prices, expressly including Value Added Tax (VAT), without prejudice to the fact that the user will have at all times detailed information on the price of the product.

PENTALIUM may periodically offer discount codes to its Users. Such discounts may only be applied in accordance with the instructions specified by PENTALIUM with respect to each code, and in any case Users may only use a single code per order.

The use of discount codes will not be compatible with certain promotional actions and collections.

5.- Information about PENTALIUM’s products and services

The data included on the website in each description of the products and services, in their photographs, graphic or iconographic representations or videos as well as trade names, trademarks or distinctive signs of any kind, have a purely informative function. Therefore, PENTALIUM declines any responsibility for the appearance of errors in said information, although it undertakes to take all measures within its power to correct the aforementioned errors or omissions as soon as possible after having been informed of them.

6. Shipping Information

PENTALIUM offers free shipping costs for orders over 45 euros. For expenses lower than 45 euros the shipping cost is 4,5 euros, being paid by the customer. This cost will be indicated in the purchase process.

PENTALIUM undertakes to deliver the products in perfect condition to the address indicated by the Customer, within a delivery time that will vary between 24 and 72 hours, depending on the type of product and shipping location.

All products are delivered by hand by the transport agency (Envialia). If you are not at home, you will be notified so that you can pick it up at the courier office of the corresponding carrier or a delivery time will be established.

Deliveries made by PENTALIUM are made from our offices or logistics centres, located in Seville and Madrid. At PENTALIUM it takes us between 24 and 48 working hours to process an order, after which we will send it to you. The shipping time for our orders is between 1 and 3 days.

Peninsular (Spain)

Standard shipping price: 4,5€.

  • Your order will be prepared and shipped within 24/48h.
  • Delivery time will be 1-3 business days from date of shipment.

We do not ship to the Balearic Islands, Canary Islands, Ceuta or Melilla.

These times and prices are subject to change during promotions or special circumstances.

Order tracking

When making a purchase at PENTALIUM the consumer and user will receive a confirmation email with the order number and invoice, if indicated during the purchase process. You will then receive an email with a tracking link when your order is picked up by the carrier. If the consumer and user has any doubts during the shipping process, he/she can contact directly the assigned shipping company or if he/she prefers, he/she can contact PENTALIUM at team@pentalium.com.

In case you do not receive your order within the deadlines estimated by PENTALIUM, the consumer and user should check the confirmation email to verify that the shipping address is correct and ask for your order to the carrier in charge of delivery. If no solution is found, the consumer and user should contact team@pentalium.com informing the number and status of your order.

If there is a problem with the shipping address indicated by the consumer and user, PENTALIUM will send a new product, but the consumer and user will be responsible for the shipping costs.

7.- Return of defective product and right of withdrawal

7.1 Returns due to manufacturing defects

The consumer and user may return to PENTALIUM, free of charge, any product that is defective or does not conform to the description within a period of three months from the date on which the product was received. Taking into account the nature of the products purchased, the consumer and user will have a period of 15 days from the date he/she became aware of the lack of conformity of the product to inform PENTALIUM about it. through the contact form provided for this purpose, indicating the defective product or products, attaching photographs and other evidence that demonstrate the defects or lack of conformity of the products, as well as a detailed list of the defects found, the purchase order and any other additional documentation that identifies the purchase made by the consumer and user.

Once you OncePENTALIUM has received the communication from the consumer and user and has analysed the incident through its Quality Department, it will inform you as soon as possible about the return process. PENTALIUM will indicate to the consumer and user how to send the defective product to its warehouses. However, PENTALIUM will not, under any circumstances, be responsible for products that are returned without having been returned by the consumer and user in accordance with the aforementioned process.

In the event that due to the characteristics of the specific product and the defect it is possible to repair it, the consumer and user will be expressly informed of this circumstance, giving him the possibility to choose between replacement or repair.

In line with the above, the consumer and user may replace the defective product for another of identical characteristics, not assuming any cost to replace the product. If it is not possible to replace the defective product with another of identical characteristics, you will be offered the possibility to choose another product.

PENTALIUM informs consumers and users that the term of the refund of the amounts paid will depend on the method of payment used by the consumer and user when purchasing the product:

  • If the consumer and user has paid by credit/debit card, PENTALIUM will refund the amount paid within fourteen calendar days after the consumer and user decided to terminate the contract.
  • If the consumer and user has made the payment through PayPal, PENTALIUM will refund the amount paid within 24-48 working hours after the consumer and user decided to terminate the contract.

In any case, PENTALIUM will refund the amounts paid as soon as possible and, in any case, within fourteen calendar days from the date on which the consumer and user has informed of their decision to withdraw from the contract and the product has been received back.

7.2 Right of withdrawal

The consumer and user will have the right to cancel the order placed remotely without giving any reason, during a period of fourteen (14) calendar days from the correct receipt of the product. The consumer and user may send the entire order or, if you prefer, may send any of the products that make up the total order and, all without penalty and without having to indicate the reasons.

The consumer and user shall bear the direct cost of the return to PENTALIUM, whether he/she returns the entire order or decides to return only some of the products of the order.

To formalize the return, you must contact PENTALIUM at team@pentalium.com. Upon receipt of such communication, PENTALIUM will indicate how to send the order to its offices or warehouses.

The consumer and user must send the product to the following PENTALIUM offices/warehouses: INSUR Building, Avenida Diego Martinez Barrio 10, Floor 3, Module 15, 41005 (Seville).

PENTALIUM is not responsible for the courier company that the consumer and user hires for the return of the order. In this sense, PENTALIUM recommends the consumer and user to demand to the courier company to provide the proof of delivery once the courier has deposited the product at the offices of PENTALIUM, so that the consumer and user has proof that the product has been correctly delivered to PENTALIUM. PENTALIUM is not responsible for the address where the consumer and user sends the order for its return if it is different from those indicated. PENTALIUM may request the consumer and user to send said proof of delivery in order to confirm the same.

The costs of returning the order (such as, for example, shipping costs via courier companies) shall be borne directly by the consumer and user.

Once PENTALIUM receives the order it will proceed to refund the full amount paid by the consumer and user.

If the consumer and user decides to return the order in full, PENTALIUM will refund to the consumer and user the full amount paid by the consumer and user (including the shipping costs related to the delivery of PENTALIUM to the consumer and user).

If the consumer and user only wishes to return one or some of the products that were part of the order, PENTALIUM will not be able to refund the shipping costs that the consumer and user has paid for the entire order.

8.- Product exchange policy

PENTALIUM does not allow the exchange of a product purchased by the consumer and user for another product offered on the Website.

In the event that the consumer and user wants to change a product, he/she must exercise his/her right of withdrawal in accordance with the provisions of clause 7.2 and then buy the new product he/she wants.
